ICeniuye phelps@century21 dickinson.com REAL ESTATE O: One of the duties Real Estate Brokers and Salesperson (Agents) afford those they represent is OBEDIENCE which is carrying Dick Phelps out the client's Lawful Instructions. What constitutes a lawful or unlawful instruction? A: In the course of working through the hundreds of Real Estate transactions I have been asked to follow what I considered Unlawful Instructions and have, in every case, refused. Some of the requests have been extremely disgusting in nature while others based merely on ignorance of the law. If a client for example knows of a material fact about a property which could affect the use and enjoyment of the property and reveals it to me and asks me not to reveal it, that is an Unlawful Instruction which l cannot and will not follow. For example the client may know the presently dry basement gets wet in the Spring and does not want me to tell the buyer. Once I know of a material fact, I am required to disclose. If I client tells me they don't want to sell to certain parties, for example one of the Protected Classes, this is an Unlawful Instruction (based on bias, prejudice and ignorance). I will immediately refuse the instruction and do two things; first, inform them that it is an Unlawful Instruction and secondly inform them they need to find another Agent. Remember: In Real Estate transactions, "I am to do nothing to the detriment of either party."
